Definitions

‘Terms and Conditions’ means the terms and conditions of sale set out in this document and any special terms and conditions agreed in writing by the seller
Conditions
Nothing in these terms and conditions shall affect the buyers statutory right as a consumer. These Terms & Conditions shall apply to all contracts for the sale of goods by the seller to the buyer and prevail over any other documentation or communication from the buyer.
By placing an order with us it would be deemed that you have agreed our terms and conditions.
Any variations on these terms and conditions would be not be applicable unless agreed in writing by the seller.
Ordering
When placing an order through the website, the technical steps the buyer needs to take to complete the order process are described in the ordering and payment section.
Any quotation must be accepted in writing by the buyer within 21 days from the quotation date
When goods ordered by the buyer are not available from stock , the buyer shall be notified and given the option, to either wait until the goods are available or cancel then receive a full refund with in 30days.
Price and Payment
The price of goods stated on the www.bellahome.co.uk website includes VAT @15%. The price excludes delivery charges. All prices are in pounds sterling and are valid only for delivery to UK mainland address.
Whilst we are happy to consider requests for products and enquiries from outside the UK . we give no warranty or implied that the placing of such an order through this web site, from outside of the UK ,complies with any non UK laws or regulations.
The seller can not except responsibility for other countries local taxes and customs charges as we have no control over these charges and cannot predict them. Please contact your local Custom & Excise office for further information.
Payment of the price includes VAT and delivery charges must be made in full before dispatch of the goods
Rights of the seller
The seller has the right to adjust prices and specifications of any item on the site at their discretion
The seller reserves the right to withdraw any goods from the site at any time
Delivery
The Buyer should read the details on the Delivery Information page which forms part of these terms and conditions
The delivery of goods in the UK will normally be within 14 working days and in most cases 4-5 working days from order acceptance.
The delivery of goods outside the UK will normally be within 28days from order acceptance
The seller uses The Royal Mail or alternative courier services to deliver your order. The seller works closely with these services to ensure the best possible service, however delays out with the sellers control may occur.
For security reasons, a signature will be required to acknowledge receipt of the goods. We recommend that an alternative delivery address is provided when known that no one will be available to sign. The couriers will leave an alternative delivery instruction card if there is no one available to sign at the given delivery address.
The Delivery Charge for postage and packaging for standard delivery to mainland UK is £4.95. Larger items such as furniture may incur an additional charge of £40-£80 depending on the size of the item. Shipping to overseas destinations will be priced on an individual basis and quoted to the buyer by the seller.
Failure or Refusal to take Delivery
If the buyer refuses or fails to take delivery of the goods or fails to take any action necessary on their part for delivery and/or shipment of the goods, the company shall be entitled to terminate the contract with immediate effect
Inspection
It shall be the responsibility of the buyer to inspect and check all goods immediately on delivery to ensure that such goods are those ordered by the buyer and are in good order. Discrepancies shall be reported to the seller by email or letter within 7 days of receipt of the order. If the buyer fails to do so the buyer will be deemed to have accepted the goods
Returns and Exchanges
Goods must be returned by the buyer at the buyers expense and should be adequately insured during the return journey. The Buyer will receive a full refund for the goods ,but not for delivery charges and return postal charges. If the buyer fails to return the goods following cancellation, the seller shall be entitled to deduct the cost of recovering the goods from the buyer.
Returned goods by the buyer must be returned in its original packaging with all tags, labels and documents still in place. The buyer must re-wrap items securely. Please note that the parcel and contents that the buyer returns to the seller is the buyer’s responsibility until it is reaches the seller.
These conditions do not affect your statutory rights.
Risk and Title
The goods shall be at the buyers risk immediately on delivery to or into the signatories custody on the buyers behalf and the buyer should insure accordingly. The goods shall remain in the ownership of the seller until such times as the buyer has paid the company the agreed price including additional charges such as delivery fees. The seller reserves the right of repossession of any goods to which it has retained title
Limitation of liability
Except as may be implied by law where the buyer is dealing as a consumer, in the event of any breach of the terms and conditions by the seller the remedies of the buyer shall be limited which shall in no circumstances exceed the price of the goods and the seller shall under no circumstances be liable for any indirect, incidental or consequential loss or damage whatever.
Nothing in these terms and conditions shall exclude or limit the liability of the seller for death or personal injury resulting from negligence of the seller or that of the sellers agents or employees
The representations of the various products are limited in the resolution of the image and cannot give a fully accurate representation of the colour and shades of the goods offered for sale due to the limitations of any visual display equipment
Due to the uniqueness and hand made finish to many of the products offered for sale the dimensions, colour and shading may vary slightly for each item
Waiver
No waiver by us the seller of any provision of the conditions shall be construed as a waiver for any proceedings, succeeding or continuing breach of any provision of the conditions
Force Majeure
The seller shall not be liable for any delay or failure to perform any of its obligations if the delay or failure is a result of circumstances out with reasonable control including but not limited to acts of god, government actions, war, national emergencies, acts of terrorism, labour dispute, floods or fire.(whether or not relating to our workforce or agents) or restraints or delays affecting carriers or delay in obtaining supplies of adequate materials or products
Severance
If any of these terms and conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction, then such terms and conditions shall be severed and the remaining terms and conditions shall survive and remain in full force and effect continue to be binding and enforceable.
Changes to Terms and Conditions
The seller is entitles to alter these terms and conditions at any time, but this right shall not effect the existing terms and conditions accepted by the buyer at the time of making a purchase
Interpretation
The choice and order of heading for these terms and conditions are for convenience only and shall not govern the interpretation of these terms and conditions
Governing Law
The terms and conditions will be governed by and construed in accordance with the laws of Scotland whose courts will have exclusive jurisdiction in any dispute, save that we have the right at our sole discretion to commence and pursue proceedings in alternative jurisdictions.
